Apply for divorce

According to Hong Kong's Matrimonial Causes Ordinance, unless it can be proven that both parties are in extreme hardship and other exceptional circumstances, a divorce petition can be filed in court only after the marriage has been completed for at least 12 months. Petitions can be handled in different ways, such as "unilateral" or "jointly". The documents required, the timeline and whether it is appropriate to mediate or negotiate first will all affect the overall arrangement.

Hong Kong divorce custody

Child custody is generally granted by the court in the form of a decree, which gives the awarded party the power and responsibility to care for and supervise the children on a daily basis, and to make decisions about the children's daily life and welfare. When handling relevant disputes, Hong Kong courts have always given "the best interests of the child" as the primary consideration, and will take into account comprehensive factors such as the child's age, wishes, the ability to take care of both parties, a stable living environment, and maintaining a relationship with both parents.

In addition to sole custody, the court may award joint custody, impose visitation or contact schedules, or make restrictive arrangements in special circumstances. In practice, it is often necessary to deal with issues such as school, medical care, religion or immigration at the same time. Claiming alimony

Alimony is intended to reduce the impact of divorce on the economic life of both parties and allow the financially weaker party or his or her minor children to receive reasonable support. The court or both parties may, through an agreement or decree, stipulate periodic payments, lump sums, or other combination arrangements; temporary alimony may also be applied for before litigation to meet transitional expenses.
