Do I have to give reasons for filing for divorce?
The petitioner must prove to the court that the marriage hasBroken beyond repair. Common justifications under Hong Kong law include (excerpt):
- The spouse has committed adultery and the petitioner believes that he can no longer live with the spouse;
- The spouse's conduct creates a situation in which the petitioner cannot reasonably be expected to live with the spouse;
- Before filing the petition, both parties hadSeparated continuously for at least one yearand the other party agrees to divorce;
- Before filing the petition, theSeparated continuously for at least two years(In this case, the other party’s consent is not required);
- Before filing the petition, the petitioner had been married to his spouseAbandoned for at least one consecutive year。
Joint applicationIn this regard, both parties must prove to the court that they have been continuously separated for at least one year before applying for divorce; or that a divorce consent notice signed by both parties has been submitted to the court no less than one year ago and has not been withdrawn (the details are subject to legislation and individual cases).
